IDAHOT & IDAHOBIT take over from IDAHO in awareness of Bi/Trans/Homophobia

International Day Against Homophobia

The annual, since 2005, IDAHO Day celebrates the 1990 removal of homosexuality from the WHO’s International Classification of Diseases (ICD). That it took 17 years from the American Psychiatric Association’s (APA) initial tentative removal of homosexuality from the Diagnostic and Statistical Manual of Mental Disorders (DSM) demonstrates how long change in these areas can take.

Whilst IDAHO initially concentrated on homophobia and lesbophobia – though rarely naming the latter, gay rights have moved on. Over time they have become Lesbian and Gay, LGB, more recently LGBT, with even Stonewall England & Wales now Trans inclusive. The debate over that may be over,  but the inclusion of I for Intersex, Q for Queer, and a panoply of other letters including Pansexual, Asexual, Non-Binary and more, still rages.

Biphobia and Transphobia (IDAHOBiT)

The addition of ‘T’ for Transphobia, turning the acronym from a US state into the less likely to be confused IDAHOT, happened in 2009 but for many has still not taken root. Bisexual erasure is sadly commonplace and the explicit inclusion of Biphobia is more recent still, creating the more fun acronym IDAHOBiT, that sounds like a type of Middle Earth hobbit! Will adding yet more letters create an even more mythical sounding alphabetical chimera?

What about including Intersex?

Do intersex people even suffer interphobia? Yes of course they do. It can, however, appear as any of the other phobias as cases of mistaken or misunderstood identity. Nor is it really an identity, it is not a sexuality or gender, but a sex that may not be fully male or female or varying degrees of combination of the two.

Interphobia may exist in cases of law, sport, services or facilities, which may be defined only in male/female terms, excluding and discriminating against those whose nature may not wholly fit into one of those narrowly defined sex categories. Thus, interphobia is a form of sexism – which itself is often binary-sex defined. The worst case of interphobia is still that exhibited by medical clinicians and some parents who often try to shoehorn intersex children into one bodily sex category or another via non-consensual surgeries (on the part of the child).

Some LGBTI and LGBTIQ/LGBTQI groups have taken to including intersex as the ‘I’ of HOBIT, erasing the original purpose as the ‘i’ of Bi. It is, furthermore, doubtful whether intersex advocacy organisations were even asked whether they wanted to be part of HOBIT, or indeed HOBiTI. “Nothing About Us Without Us” was the appropriate battle-cry of disability activists, which might be co-opted here – with respect. That said, few would turn down the opportunity for increased understanding and awareness, so long as the education is accurate and publicity helpful, which it is not always. Misplaced good intentions and misappropriations can do more harm than good.

OII UK, the UK arm of the leading international intersex organisation, has praised the United Nations Human Rights commissioner for drawing attention this IDAHO Day to the plight of not only LGBT youth but also intersex youth stating that:

“intersex children and young people may be subjected to medically unnecessary, irreversible surgery and treatment without their free and informed consent. These interventions can result in severe, long-term physical and psychological suffering, affecting children’s rights to physical integrity, to health, privacy and autonomy and may constitute torture or ill-treatment. States should prohibit such interventions.” –  Office of the UN High Commissioner for Human Rights

What about the Others?

Pansexuals can be accused of not being real or be erased, somewhat ironically, by bisexuals – usually the chief victms of erasure. Non-binary and agender folk can experience something similar. Asexuals can often be misconstrued and misunderstood. A Facebook post by the 1.5-million-followers popular Lizzy the Lezzy page ran a comical post on asexual attitudes to sex which had some 2000 shares and hundreds of illuminating comments, many spot on, but some exhibiting the abusive assumptions that “sexuals” may have, that “having sex” should be an entitlement within a relationship.

Inclusion and Acronymitis

Diversity and equality should mean full and equal inclusion for all, It can, though, become unwieldy over time, as the tail becomes longer than the original dog, and those at the head of “gay rights” begin to resent being wagged by the ever-lengthening tail, which few may understand except those in MOGAI, AVEN, Alt and Fetlife communities. In the same way, in the UK, Race Equality, Sex Discrimination and Disability provisions were eventually combined with anti-homophobia initiatives to create the 2010 Equality Act. At some point IDAHO Day will need to become the International Day Against Hate and Discrimination Based Upon Sex, Orientation, or Identity. Quite a mouthful but shorter than IDAHOBiTIQA…XYZ. In short, human rights and respect – something in the 21st century we should all be moving towards, if not arrived at. “LGBT rights are human rights” as the recent Council of Europe report reminds us. Until that day, IDAHO/Bi/T reminds us that we are not there yet, but still undeniably a work in progress.

Google goes gay, Twitter flags up rainbows, Search terms for LGBT Pride

This year’s “Google goes gay” search style for Pride Month and the Stonewall Inn riots anniversary was a tessellated rainbow background strip to their website menu bar. This is the 7th year running Google has demonstrated its diversity and made the none too subtle statement of support worldwide.

Enter terms like “Gay Pride”, “Stonewall riots”, “Pride month”, “London Pride”, “Same-sex marriage” and the strip would visibly transform before your eyes and produce tens of millions of results. Curiously and sadly “Gay Pride” dominated and “LGBT Pride” was ignored. Searches for LGBT, GLBT or LGBTQ were rainbow styled but not the more inclusive LGBTI or LGBTIQ/LGBTQIA, excluding Intersex people from the gender and sexuality spectrum terminology despite inclusive advances elsewhere, such as in Europe, with the shift to LGBTI/Q.

Google has gone “gay” before, last year same-sex marriage was highlighted during Pride Month because of the US Supreme Court Defense of Marriage Act (DOMA) and Prop 8 rulings. Outside of LGBT calendar events Google has also been political in support of LGBT gay rights. It has created 2000+ Google doodles over the years and for the Winter Olympics in Sochi, Russia, it added a far from subtle LGBT activism to its logo doodle by using the 6-banded rainbow flag colours behind various sports events images. The search box would also come up with the Olympic Charter words highlighting inclusivity in sport as an obvious dig at Putin’s anti-gay education laws: Google Winter Oympics, Sochi Russia, LGBT Doodle

This year, someone has also discovered an “Easter Egg” or hidden coding within Google Docs Sheet (similar to Excel) that turns the entire spreadsheet’s column background colours rainbow hues simply by typing P in Cell A1, R in Cell A2, I in Cell A 3, D in Cell A4 and E in Cell A5, spelling out “PRIDE” across the first row columns.

Microsoft’s older Excel versions have long had hidden Easter Egg programs buried within, several were full blown racing or Doom style games. #Pride hashtag on Twitter 2014Twitter #Pride hashtag flagMeanwhile, during this year’s Pride weekend, Twitter has interpolated a mini rainbow flag  image anytime the hashtag #Pride was used.

Search Engine Land monitors Google’s annual LGBT activist and temporary re-branding of search results. Personally, I think it’s great, but it’s also clearly far from neutral, or non-partisan. It shows the world’s largest search engine is on side, but also political which makes one worry in what other ways it manipulates results and opinion. Corporate Cultural Change – Can Big Business be a Force for Good? What about People Power?

Can business behemoths end bigoted prejudice in conservative cultures? Can this assist people power movements, or is corporate collaboration selling out?

We all like to blame big business and banks especially for the financial crisis and resulting austerity, not to mention bonus culture and tax avoidance, but can they be a force for good too? Are they big enough to effect change and shift cultures in otherwise more conservative or religious societies that may discriminate against LGBTI+ people or women, not only in employment, but in life? By being openly supportive of LGBTI+ and other minority employees, creating safe spaces for them at work, helping stem existing employment prejudices, can change happen?

Goldman Sachs in Singapore is doing just that. In a public student recruitment drive it has positively targeted LGBT students, inviting them to dinner to discuss issues such as being ‘out’ at work in the local culture.

Goldman Sachs has a strong track record on diversity with positive employee networks such as their Disability Interest Forum, Women’s Network, and LGBT Network.

Alongside Goldman Sachs are similar stances by JP Morgan, Google, Barclays and BP. Barclays Bank were not my favourite bank in 1970s/80s student politics with their pro-Apartheid trading, the University Union I was then at, UCL, refused to take Barclays payment cards in protest. In 1977 after UN embargoes on South Africa, Barclays pledged support for Botha’s racist regime. Yet now, here in Norwich, Barclays boasts several gay bank managers and proudly marches with Norwich LGBT Pride. The University of London Union, the biggest in Europe with 120,000 members now acts on issues such as Palestine.

We acknowledge people power, indeed we have the power to change bad corporate practice, worker exploitation, tax avoidance, for example by boycotting their products, be they Starbucks, Vodafone, Amazon, Apple etc, but do we? UK Uncut, the Occupy movement, showed the power we have as consumers – if we follow through. To paraphrase Plato’s “The price of apathy toward public affairs is to be ruled by evil men” our hypocritical inaction as consumers going for cheap over ethical, image over substance, is to be ruled over by Tescos and High Street coffee shop clones.

Capitalism is not inherently evil for it carries with it the power of its own demise or change. Consumer choice, people power, stockholder revolts, pay package rejection, the freedom to form unions. When the banks failed us in 2008-9 we failed ourselves by rescuing them, indeed it was a so-called Socialist, well ‘new’ Labour government that here in the UK aided their rescue. Unbridled free market capitalism would have effected change by allowing them to fail and something new and better form and take their place. But we, and I include myself here, are all hypocrites, still selecting the cheapest deal, not investigating their ethics and practices. When we buy from Amazon we destroy smaller, local businesses, we lose our bookshops. It is evolution, but of business, and as consumers we are partly responsible.

So can corporations be beneficial too? Certainly, with all their power they have some degree of moral responsibility and diversity in the workplace is an economic benefit, aiding creativity and bringing alternative perspectives, rethinking outside the box.

Goldman Sachs’ positive employment policy in Singapore and support of the emerging LGBTI rights movements there such as Pink Dot are a powerful force for freedom. Technically, homosexuality is still illegal in Singapore but Pink Dot and its inclusive promotion of “freedom to love, regardless of sexual orientation” has seen its inaugural gathering in 2009 grow tenfold in just 4 years, with the next Pink Dot, now jokingly called the Pink Whale – due to aerial views of its event growth, due to be held 28 June.

Google, for all their domination of Internet search, privacy questions and more, also have profoundly positive employment policies and with subtle changes of their logo doodle each day can send messages to billions. They’ve even done special rainbow styling on LGBT and equal marriage searches during big votes on the issue.

Though, are companies like Goldman Sachs meddling with local culture by being brazenly equality-minded? Is it a throwback to Western colonialist imposition or patronisingly paternalist interference? Certainly, we haven’t got equality right in our own countries yet. Gay British footballers don’t feel safe to come out yet. Lord Browne, the former chair of BP, never felt it acceptable to be ‘out’ at work, indeed he only did so after resigning when he was about to be ‘outed’ by an ex-lover.

Again, it works both ways, we as consumers and as corporates have the power to effect change. Mozilla’s CEO was forced out, no not in that sense, he wasn’t gay, he lost his job for supporting an anti-gay marriage campaign in the US. Boycotts of their browser by LGBT campaigners and staff forced him to quit. In reaction, conservative groups in America boycotted the Firefox browser for its support of equal marriage.

Corporate sponsorship is not evil of itself and can help people recognise inclusive employers that are safe to work for. In some societies where equality is still an emerging issue, it can be a risky stance to take, but globalisation can bring equality benefits to all countries where companies have representation. Check out the statements of the likes of Google, Goldman Sachs, JP Morgan and BP on Pink Dot’s website.

Wael Ghonim, Revolution 2.0 - The power of the people is greater than the people in powerEgyptian Wael Ghonim, just 33 years of age, has worked for Google in Egypt and UAE since 2008, though took time out in 2011 during the Egyptian Revolution as part of the Arab Spring in North Africa and the Middle East. He was detained and interrogated by Police for 11 days during the pro-democracy rallies having been a prime mover behind some of the social media, Facebook and Twitter, harnessing of people power.

Ghonim was interviewed on CBS’ 60 Minutes saying:

“Our revolution is like Wikipedia, okay? Everyone is contributing content, [but] you don’t know the names of the people contributing the content. This is exactly what happened. Revolution 2.0 in Egypt was exactly the same. Everyone contributing small pieces, bits and pieces. We drew this whole picture of a revolution. And no one is the hero in that picture.”

Ghonim was Time magazine’s no#1 on their annual world’s 100 most influential people in 2011. In the same year he was awarded the Press Freedom prize on World Press Freedom Day.

In his 2011 TEDx talk in Cairo, on the inside story of the Egyptian revolution, he said “The Power Of The People Is Much Stronger Than The People In Power”  (9m26 into the video)

“Revolution 2.0 – The power of the people is greater than the people in power”, is also the title of Ghonim’s 2012 book, described by the San Francisco Chronicle as “a gripping chronicle of how a fear-frozen society finally topples its oppressors with the help of social media”.

Philanthropic capitalists have also searched for Capitalism 2.0, a “creative capitalism” that sacrifices profits for public welfare, as Bill Gates said in 2008. The 400+ billionaires of the Giving Pledge who have volunteered to give away more than half their wealth, some as much as 95% of it, are definitely have the power to change things. Milton Friedman might have argued that profit was the only motivation in business, but green businesses, community interest companies and the realisation that good PR, ethics and equality, can actually raise profits, are changing that.

London, 27 May 2014, saw a conference on so-called “Inclusive Capitalism“. Focused on renewing trust, one could easily dismiss the initiative given the likes of Rothschild and Bill Clinton’s involvement. Indeed, Dr Nafeez Ahmed, writing in the Guardian, called it PR spin and a “Trojan Horse” to quell a coming global revolt. So is corporate inclusivity to be trusted?

Rarely, too, are situations simplistic. take Starbucks, they have used legal methods to avoid tax liabilities and yet have also paid Ethiopian coffee farmers a 75% premium over market prices as corporate welfare. Fair Trade schemes may appear to benefit third world producers but in some countries they are not the most beneficial or ethical system and stringent label certification can lock out smaller producers and increase inequality.

South Africa is the largest producer of Fairtrade wine in the world and yet, even there, concerns about traditional FairTrade labelling and its insufficient benefits to workers have led to rival schemes such as Fair for Life and others that go further, offering housing, healthcare and education to employees. Stellar Organics is one such winery where it is 26% owned by the workforce and Fair for life certified.

It is both complex and simple, we can use social media to produce “The People 2.0”, informatise and organise, communitise and unionise, we have the power… make corporates recognise that, and society and governments can and will change.

UK Parliament tables Non-Gendered Identity 3-option M-F-X Passports

Third/Non-Gender passport options could be debated in the UK Parliament following a lengthy campaign by people outside the male-female gender binary who feel erased and discriminated against.

[UPDATE – Government “considering” changes to gender identity laws, passport and driving licence changes. Maria Miller, chair of the Commons Women and Equalities committee, said a person’s sex was “not relevant” on official documents, and it created an “unconscious bias” in job applications. Gender details on passports also do not assist with identification, she added. The committee will publish a report on transgender discrimination in January 2016. In an interview with The Times, Miller said gender stereotyping can be as “damaging” for men as women.]

Three gender option passports

A motion was tabled yesterday (5 June 2014) in the UK Parliament to allow non-binary M/F passport gender markers in the UK, to aid those that identify as non-gender, non-binary, agender, bigender, or intergender – or simply hate gender construct labels. The internationally allowed X marker already allows this, not as some compulsory trans or third gender marker which could be used to reduce people’s rights as citizens, but as a self-selected optional marker for those that feel they do not fit the only 2 options given in UK and most nation’s passports. Australia and New Zealand accept the non-gender specific X passport as do India, Nepal and Pakistan. Canada is debating change; Malaysia are allegedly considering removing gender from all passports. Argentina makes switching between Male & Female easy, without legal-medical requirements for trans, intersex, genderqueer, or anyone else for that matter – a move, it has been announced, that Denmark looks set to follow.

This motion is essentially a re-tabling of previous attempts, but taking advantage of a new Parliamentary session – it will need hundreds of signatures to even trigger a full debate.

“Although there is very little prospect of EDMs being debated, many attract a great deal of public interest and frequently receive media coverage … In an average session only six or seven EDMs reach over two hundred signatures. Around seventy or eighty get over one hundred signatures. The majority will attract only one or two signatures. An EDM is not likely to be debated even if it gains a large number of signatures.” Parliament.uk

The move follows LibDem sponsored Government reviews into this since 2011, and yet progress had stalled. The new early day motion has been sponsored by Julian Huppert (LibDem) and is supported by Jeremy Corbyn (Labour). Non-gendered Christie Elan-cane has long fought for non-gendered passports and had her case taken up by MPs such as David Blunkett (Lab), Liberal Democrat MPs Lynne Featherstone and Simon Hughes and Baroness Sarah Ludford MEP.

One might think that just two options M/F on passports prejudices just trans, intersex and genderqueer people but if part of a family then gay, lesbian and trans are also affected as the designated parents on child passports. Some countries, including the US have thus adopted gender-neutral parenting option on children’s passports, not mother/father but parent 1/parent 2.

The words “mother” and “father” were being removed from American passport applications and replaced with gender neutral terminology, the US State Department said in 2011. The UK and Australia were said to be following suit.

Legal documents that reflect a person’s gender – or non-gender identity are a basic human right. Denying them, restricts, travel, identification, and citizen rights such as voting or access to welfare benefits.

Elan-Cane prefers ‘per’ in place of him or her and the honorific title Pr, short for Person, neither Mr nor Ms. Shouldn’t we all be entitled to be seen as persons first, and not primarily gendered categories?

Facebook now has some 50+ gender options, why do we need any on official documentation? The military does not use gender as a means of identification, just name and rank. Height, eyes, and finger prints should be sufficient on biometric passports. Gender, race and identifying marks are invasive, insufficient and inappropriate. Nationality, for the sake of legal travel rights and repatriation. But I cannot see how gender matters.

Update on “X” Gender not specified UK Passports

During the current April-May 2015 General Election campaign, several parties, initially just the Greens and LibDems, but now both Ed Miliband (Labour) and David Cameron (Conservative) have pledged to re-examine X-Gender passports:

IDAHO day, the International Day Against Homophobia and Transphobia

May 17, each year, is IDAHO day, the International Day Against Homophobia and Transphobia, since 2009 called IDAHOT to fully incorporate Trans people. I’ve always prefered the longer IDAHOBIT to include Homophobia, Biphobia, Intersexphobia and Transphobia, not to mention the little people with hairy feet from Middle Earth!

May 17 was the day that homosexuality was removed from the International Classification of Diseases (ICD) of the World Health Organization (WHO) in 1990. IDAHO day first took place in 2005 with activities taking place around the world including the first ever LGBT events to take place in the Congo, China, and Bulgaria.

In 2009 Transphobia was added to the day’s remembrance and activism although, unlike homosexuality, trans activists are still campaigning to have Gender Dysphoria removed from the various mental health classifications (ICD10/11, DSM-IV/V), though France was the first country to do so that same year. In May 2012 Argentina passed a radical groundbreaking Gender Identity Law depathologising trans and providing medical access for all without psychiatric hoop-jumping. Argentina should be watched and observed to see if its model becomes one that could be followed by other nations and allow for the safe and full depathologisation of transsexuality.

ILGA LGBTI Report

Times have changed and things improved since the removal of the criminal threat and mental health stigma from homosexuality, at least. If a recent ILGA LGTBI report is to be believed, Britain is the best place to live if one is lesbian, gay, bisexual, trans or intersex.

 ILGA LGBTI Europe map 2014Launched to mark IDAHOT day, the ILGA Rainbow Europe Map “reviews the standing of European countries against essential legal benchmarks for LGBTI equality, while the Annual Review of the Human Rights Situation of LGBTI People in Europe 2014 provides an analysis of trends and an overview of key political and social developments country-by-country.”

For many there were improvements, such as same-sex marriage (although not in Northern Ireland) and for some to the East of Europe, such as Russia, a deteriorating situation of LGBTI freedoms and protections.

Apparently, the UK has the best laws (the 2010 Equality Act was pretty groundbreaking), rights and freedoms, even better than the Netherlands, Spain, or Scandinavia. This is partly down to some nations being gay and lesbian positive but then failing on trans and/or intersex, and usually totally ignoring and hence erasing bisexuals.

Homophobic & Transphobic Hate Crime

Here in the UK, homophobic and transphobic crime seems to be on the rise, although this may just be perception and/or data inflation, since increased numbers may just be better victim reporting and police recording, rather than increased incidence of hate crimes or incidents. We’ve been tackling racism for decades and it doesn’t go away over night. Just ponder the upcoming European elections and the 30% vote share that UKIP the party of xenophobia are likely to gain. Fear of difference is still endemic everywhere.

A recent NUS report into the experience of gay and trans students demonstrates that schools and colleges are still not safe places for LGBTI people. Only 20% of trans students feel safe or accepted in higher education. 20% of LGB+ students and 33% of trans respondents experienced at least one form of bullying or harassment on their campus, making them 2-3 times more likely to drop out of education, affecting future job prospects, and mental health and wellbeing.

Trans students are 2.5 times more likely to have a disability in addition to being transgender. They are, furthermore, the group at the greatest risk of suicide with 34% attempting it and up to 80% considering it. Thankfully, the UK is better than many other places and these figures are greatly increased elsewhere, e.g., the USA, Eastern Europe, etc.

Other Rights Still Not Equal

The right to bodily integrity of people with Intersex conditions (people with differences of sexual development, sometimes unhelpfully termed “disorders”, DSD) is an issue still being fought for. Just because gay rights are seemingly “in the bag”, same-sex weddings won, does not mean trans or intersex people have the same or equal benefits, nor does it mean that any LGBTI person is free from bullying, hate crime or prejudice in the workplace.

Equality itself is not yet equal, either between different strands of the diversity umbrella of protected characteristics nor across different countries in the EU, Commonwealth, or world. Some 80 nations have laws that still criminalise homosexuality, some with the death penalty. Just because a civil rights battle is part-won in one country does not mean that is everyone’s experience, either at home or abroad. So days like IDAHOBIT, regional and national LGBTIQ Prides, are still needed to remind us of how far we have come, and… how far we still have to go to achieve equality, acceptance and freedom for all.

India gives equal rights to Hijra trans as third gender identity

India has, today, ruled in its highest court that transgender people, usually called Hijra there, will henceforth have the option to be recognised as a third gender and all forms, documents and facilities will have to provide for them as such. Whilst numbering some 2-5 million people or up to 1-in-200 of the population, they will be given minority rights, job quotas, full access to education, adoption and healthcare.

In development since 2009, and in time for India’s current elections, the Election Commission has also allowed for a third gender option, “Other”, on voting forms.

Justice KS Radhakrishnan, headed up the Supreme Court ruling and said:

“It is the right of every human being to choose their gender…Recognition of transgenders as a third gender is not a social or medical issue but a human rights issue…The spirit of the Constitution is to provide equal opportunity to every citizen to grow and attain their potential, irrespective of caste, religion or gender.”

Anita Shenoy, lawyer for the petitioner National Legal Services Authority (NALSA) said:

“We are quite thrilled by the judgement…The court order gives legal sanctity to the third gender. The judges said the government must make sure that they have access to medical care and other facilities like separate wards in hospitals and separate toilets.”

The case demanding equal rights first came to court in 2012 initiated by a trans-activist group led by trans Hindi film star Laxmi Narayan Tripathi. She said, upon hearing the ruling:

India is the world’s largest democracy yet especially in rural areas is far from an equal society. Tripathi proclaimed that, “The progress of the country is dependent upon [the] human rights of the people and we are very happy with the judgement.”

These rights are extended to trans and or intersex people that are living in a way that is different to their birth gender and yet also allows post-op transsexuals to legally choose their gender: male, female or transgender/other. Thus both binary and non-binary individuals are able to choose their identity, it is not a category that is being forced upon them but one they have fought for.

Western trans activists should remember two things here, firstly, that hijra=trans is not an exact Western/Eastern label match. The cultural evolution of their fight for recognition comes off the back of centuries of religious, social and cultural development, in context, and against different prejudices, classes and castes. Their identity was formed in the crucible of their history. We should not, therefore, seek to impose our LGBTI rights battles on their personal and political paths, we should, however, support them in their moves to self-assert their chosen identities.

Secondly, the concept of ‘third gender’ has been sought by them, whereas many in the West oppose that concept and fear its use in a 1930s anti-Semitic way to categorise and potentially segregate trans people as if with some kind of yellow star (Jews) or pink triangle (homosexuals).

Trans masculine identities in India

“If trans people are a minority with almost no rights in this country [India], transmen are a minority within that minority.” Just as “there are hijras, kinnars, mangalamukhis, aravanis, kothis, jogappas, shiv shaktis among trans women as identities, there is a wide range of trans masculine expressions”, says an Indian transman, one of 74 that co-signed a letter to the Indian Ministry of Social Justice and Empowerment, “We have many names to identify ourselves like bhaiya, thirunambi, gandabasaka, babu, ftm, trans man etc. For an umbrella term, to refer to us in all our diversity, we would like the use of the term, trans masculine. We do not identify with PAGFB [Persons Assigned Gender Female at Birth] which is what is being used in reports and meetings here to describe our identities. We strongly urge you to refer to us by identities that we assume, not ones that are imposed on us without due democratic discussions and consent.”

Another “term for FTM in Hindi is Sadhin“. Last November, an Indian trans man fled the country after being ‘outed’ by the media and sought asylum in the UK. This was before this week’s more positive news for trans rights.  Although more sparse, trans masculine support does exist in India, but they have a lower profile in society, media and rights activism.

LGB Gay Rights in India

Meanwhile, LGB rights of India’s gays, lesbians and bisexuals, are still behind the times though, having recently restored an old British colonial law banning homosexual activity. India has granted these historical Hijra rights, yet still bans gay sex in a logical anomaly. How is gay sex to be defined now there are three genders? If a newly defined Hijra/Third Gender has sex with a man is it gay or straight sex? If a Hijra has sex with another Hijra is that homosexual?

Trans rights in Pakistan

Back in 2011 after actions that began in 2009 Pakistan granted “third gender” status and improved rights to trans people, for example on national identity cards, employment and inheritance rights. Whilst many Hijra end up begging, wedding dancing or in prostitution, Pakistan has been enterprising in employing them as official agents pursuing tax evaders. Apparently, recovery rates are up 15%!

LGBT rights in Nepal

Thirteen years ago Nepal’s LGBT activists initiated a campaign for full LGBT equality, which resulted in a landmark decision in 2007 but which took another 5-6 years for full implementation of trans equality. The court decision ordered the then government to scrap all laws that discriminated on the basis of sexual orientation or gender identity, and “that they study and implement a same-sex marriage policy, and that citizens be allowed to self-identify as a third gender on all official documents and registers.”

Nepalese activists have urged the government to use the word “other” rather than “third gender” or “trans” as a “more inclusive” term that allows full “self-identification”.

Trans rights in Bangladesh

Last year, Bangladesh also granted third gender rights and recognition to Hijras – a term in Bangladesh adopted by 10,000+ people including many male-to-female presenting individuals and some intersex persons. Cabinet Secretary Muhammad Musharraf Hossain Bhuiyan said: “They will be referred to as hijras in both English and Bangla. Any other translations to English would be misleading.”

Non-Western Trans terminology

Across India, South and Southeast Asia numerous terms describe gender non-conforming people in ways which, because of cultural, historical and religious differences, are not totally synonymous with Western usage of trans terminology. For example in Thailand and, Cambodia, they are called, Kathoey, elsewhere the most common term is Hijra, but we also find Aravani, Aruvani, Jagappa, or Chhakka (Kannada), Bambaiya (Hindi), Khusra (Punjabi) and Kojja (Telugu). In Pakistan, terms include Khwaaja sira, Khusra (trans), Zenana (crossdresser) and Narnban (eunuch).

Polynesian Samoa has its Fa’afafine, Tonga its Fakaleiti, and Hawaii and Tahiti their Mahu. Both fa’a- and faka- are prefixes meaning “like a” or “in the manner of” and fafine and leiti mean ‘woman’ or ‘lady’. On the surface, therefore, they would pass as the prefix trans- before woman, but Western legal, political and cultural transgender terminology should not be imposed on their cultural-historical usage of the terms.

Native Americas traditions

Numerous indigenous Native American tribes had gender options outside the seemingly conventional Western binary. Berdache was a term meaning effeminate male used by Westerners of some tribal members encountered. More recently, the preferred term is Two-spirit, but some tribes went beyond three to several gender expressions, roles and identities. The Mohave Indians had the terms Alyha (Male-born) and Hwame (Female-born) for their Two-spirit identities. “Two-spirit natives comprised a distinct social class within most of these tribal communities; for example, among the Hidatsa of the northern Plains, two-spirits were observed at no less than fifteen to twenty a village and typically pitched their tipis together in a group.”

Similarly, among southern Mexico’s Zapotec there were the Muxe/Muxhe possibly a variant of the Spanish word for woman, mujer, describing people born male but who behaved as female in role, dress or sexuality. Because the word described effeminacy across gender or sexuality it accounted for some 6% of the population in some studies.

Argentina, Australia and New Zealand all allow passports to be stamped with the full range of internationally allowable options: Gender – | M | F | X |. Despite it being explored and to some extent encouraged by the Liberal Democrats, the UK Passport and Identity Service seems to have mothballed any likely change in Great Britain. Although as of June 2014 it has now been tabled for another Early Day Motion in Parliament, though is perhaps unlikely to reach debate stages.

In Europe, Germany has recently allowed “other” as a temporary designation on birth certificates to allow families to delay decisions on children born with intersex differences. The Netherlands are considering a third category to protect trans people during transition.

All gender designation is ultimately sexism. However, in an imperfect and unequal world some level of gender designation for protection can benefit in the here and now. Ideally gender neutral bathrooms would be the norm, but how to protect the vulnerable? The sooner all nations accept fully equal sexual relations, parenting and marriage between two or more persons of any gender, the sooner we can dispense with legal gender designation.

More important than third or more genders, reinforcing the binary, opposing the binary, gender sexism, is the simple inalienable human right to self-identify. Restricting identification, whether legally or culturally, to just two genders goes against human respect and rights especially when medically there are dozens of conditions that can make typical birth-sex identification impossible, quite apart from gender identity issues and/or gender non-conformity. Celebrate diversity and difference and the right to self-identify, as Radhakrishnan has said: “It is the right of every human being to choose their gender” – and that includes “Other” and “None”, in my opinion.

Immigration controls, an arms race of rhetoric over rational realities and positive benefits

The Labour Party Shadow Cabinet Home Secretary Yvette Cooper has promised today to clamp down on immigration, yet a year ago, said Labour will not enter an “arms race of rhetoric on immigration” … yet does. What is more, she clearly believes in recycling as half of today’s speech on immigration is 13 months old.

In the polls Labour is barely a few points ahead of the Conservatives, despite their expenses debacle over Maria Miller, and is little more trusted than the Tories. Nobody trusts the Lib-Dems for having gone to bed with the Tory government in coalition leaving Nigel Farage and the further right UKIP free to wipe the floor with Nick Clegg in the TV political debates, that Labour and Conservative leaders refused to partake in. Politics and politicians are back to an all time low. So to resurrect trust, they pick an ‘easy’ subject, soft target – immigration, one on which UKIP do well at the polls, in order to gain political traction and voter empathy. If only it were not the wrong policy, feeding on fears and not hopes, as with  Clegg and Farage’s clash in the televised EU debate. Polls show UKIP on 25-29% for the European elections.

Russian immigrants disembarking from a ship at Brisbane in 1931It’s also bad timing as Britain’s first Asian male, of Pakistani immigrant parents, whose father worked hard as a bus driver, so that he could become Chase Manhattan Bank’s youngest VP at 25, becomes Equalities Minister in the Government. So as someone of ‘immigrant stock’ gets to the top, Labour complain about non-graduate immigration, the very parentage from which Sajid Javid emerged.

It is another form of class discrimination to have Australian-styled points systems for immigration, to only allow in highly skilled and qualified foreigners, and to turn away low-skilled desperate working class migrants – not very socialist.

She told BBC Radio 4’s Today programme that “exploitation attracted low-skilled migrants, when the UK should actually be trying to attract university graduates.”

Labour allegedly got it badly wrong on immigration in their last decade in power, as Cooper admits today, again, “the last Labour government got things wrong on immigration”, and that they were committed to reintroducing full exit checks at UK borders, previously scrapped by the Labour when they were last in government. Not an apology as such, and not really necessary, if, like me, you believe in immigration, multiculturalism and healthy workplace competition.

Protectionist policies are actually very nationalistic and counter globalisation and international aid. People willing to enter this country at their own expense to take on low paid jobs, to literally “get on a bike” – to coin a phrase that when last said by a Tory minister, didn’t go down well – to find a job, even if in another country, should be praised not pariahed.

Socialism only for one’s own country is a nationalistic self-interest. Worldwide betterment and welfare of all would embrace anyone working to feed their family. So long as decent minimum wage controls are in place to prevent employer exploitation then a fair wage is on offer to anyone willing and able to take the job. British people should already have a natural advantage due to their location, education, and own-language fluency – should, I say, but may not due to poor education, training, mobility, motivation etc. There is no need or ethical basis to protect ‘our own’ over ‘immigrant’ competition. To do so, rubbishes the ethics of socialism and international welfare in the name of national interest – for which, read, political self-interest, a phrase that David Cameron has also repeated today, “Britain’s National Interest”, which apparently “sum up everything we are about in Europe.”

So, as Yvette Cooper claims, if Labour win, they would make the exploitation of migrant workers a crime, I wonder if she is protecting their political interest rather than the welfare of migrant workers, who in the same breath she would restrict the numbers of, which is not protecting them. The real aim is to reassure British voters that they will not have undue competition for their jobs and hence Labour votes. But even Patrick Wintour in the Guardian sees the proposal as “legally fraught … giving the state greater control over the setting of wages in the private sector above and beyond the minimum wage.”

It is already illegal to exploit migrant workers, it is just hard to enforce, and workers are unlikely to complain for fear of losing their jobs, or not knowing their rights. So Labour is not bringing in anything new, just tinkering for political gain and to reverse their reputation on immigration.

Her measures are nothing new, and the current Government are already “doubling the maximum fine for employers found using illegal workers … a four-fold increase in fines for firms not paying the minimum wage and increased penalties for landlords housing migrants in illegal premises.” Blatant employment of substantial illegal immigrant workers already merits potential jail terms of up to two years and unlimited fines.

Yvette Cooper also said, “When people go to work in other countries in Europe they don’t expect to be able to claim benefits as soon as they arrive and likewise, I don’t think people should expect to when they come here,” – that could have been said just as easily by a Tory or UKIP spokesperson. The current rhetoric on immigration is knee-jerk political fear that it will cost them votes unless they at least ‘sound’ tough on immigration, and the causes of immigration.

Yet Cooper kept harping on about not having:

“an arms race in rhetoric, but practical policies instead”

She used the same phrase 13 months ago:

“But we won’t enter an arms race of rhetoric on immigration – and we hope the Prime Minister won’t either. That’s not honest, or good for Britain.”

It seems to be her favourite soundbite of the moment, if a moment can last over a year. Today, according to the  Guardian she was planning to attack the approach of UKIP, saying that having simplistic solutions:

“ramps up the rhetoric, raises false promises and expectations, undermines trust and confidence, and creates division and hostility …”

“We won’t engage in an arms race of rhetoric, and we reject the divisive politics of the right that promotes hostility instead of building consensus .”

“We will never compete in an arms race of rhetoric. We will never conduct the debate in way that whips up tensions and hostility.”

Last year, in the same speech, she accused the current Government of being:

“engaged in a frenzy of briefing and rhetoric

and ended by saying:

“It means no rhetorical arms race, just sensible and practical proposals…”

So, all that has changed is proposals have become policies, yet the rhetoric remains the same.

Take, for instance, last December, when Yvette was still on the same song in an article she wrote in the Daily Mirror that the Government’s ministers’ had:

“ramped up rhetoric looks more like panic than plan. Instead of chasing headlines that increase concern and hostility, David Cameron should concentrate on sensible policies to help. Labour won’t join in a Dutch auction of tough language that helps no one.”

Yet that is all Cooper’s words are, “tough language”, allegedly in response to having “listened and learned”. Rather, it is all politicians fearing the rise of UKIP and losing the moral and media battle on immigration. They are listening to the polls and not their political principles, afraid of losing the next election not of making a better world for us all to live in, one with a great multicultural Britain, without racism, prejudice and phobias of several kinds.

Cooper also chooses some strange examples and stereotypes in her speech, suggesting that immigration has given us “Trinidadians on our hospital wards” and that the Norman Conquest was immigration not invasion!

Brits living abroad in EUDespite some of the highest levels of immigration in Europe we also have one of the lowest unemployment figures and now the highest growth figures of all Western developed economies. So, clearly, immigration is good for us. We should not forget that over 2.2 million Brits have emigrated to Europe alone from our shores. It is time to end the “arms race of rhetoric” over immigration, by Labour, Tory, and UKIP, combatants and to start seeing immigration and multiculturalism as a blessing to British society, adding to its richness and diversity. Nobody is selling the positives of healthy immigration.
